Terms and Conditions
1 Agreement
By selecting "I agree" and using the App, you enter into an electronic agreement with us under the Electronic Commerce Act (RA 8792), consisting of these Terms and the Privacy Policy. If you do not agree, do not use the App.
2 Accounts
- You must be at least 18 and give accurate information, including a mobile number you can be reached at.
- If you sign up with an email address and password, you must verify the address by opening the link we email you before using the App. Signing up with Google uses the address Google has already verified.
- One person per account. Accounts may not be shared: do not share your sign-in; you are responsible for activity under your account.
- One Free account per person. Do not hold or create several Free individual accounts (for example with other email addresses, aliases or mobile numbers) to get more classes or AI drafts than one Free plan allows. Each mobile number can be used by one individual account.
- School accounts are created and managed by the school, which may deactivate them (for example, when you leave).
3 Plans
- Free: up to 2 active classes you teach and 5 AI drafts a month.
- Pro: up to 8 active classes you teach and 100 AI drafts a month, currently ₱149 for 1 month or ₱1,499 for 12 months.
- CMS Interactive: presentations and classroom games made from your lesson plans, or games you write yourself. It can be bought on its own, currently ₱399 for 1 month or ₱3,990 for 12 months, or together with Pro for ₱499 for 1 month or ₱4,990 for 12 months. It comes with 200 CMS Tokens a month, camera games, live phone rooms, and as many hand-written games as you like. If you have both and one ends first, the other keeps working until the end of the period you paid for.
- Your own slides in CMS Interactive (made by hand, blank or from the library, with their own backgrounds) are free for every account for now, while CMS Interactive isn't on sale yet. This is a trial; we'll tell you before it ends. Slides made by the AI, and games, take CMS Tokens as below.
- CMS Tokens pay for CMS Interactive's AI: one session's slides take 3 tokens and one game 1. Nothing is taken when the AI can't make it.
- Without CMS Interactive, an individual account gets 3 free tokens a month on Free, or 9 on Pro, and its first 5 hand-written games (games played without the camera) free; after that each new hand-written game takes 1 token. Free tokens and free games are per person, like the Free AI allowance, and need a verified, lasting email address.
- Token packs (individual accounts): currently 25 tokens for ₱49, 60 tokens for ₱99, 130 tokens for ₱199. Bought tokens are used after the month's tokens, carry over, and don't expire while your account exists. They have no cash value, can't be moved to another account, and end if the account is closed.
- Free trials: we may give every individual account Pro, and every account without CMS Interactive (school staff too) CMS Interactive, for set dates announced in the App, with AI tokens that are used before the month's free tokens and expire on a set date. During a trial you can run live phone games and camera games; after it they need CMS Interactive again. After a trial, your plan is as it was, and everything you made stays. Without CMS Interactive, free tokens are also limited per day (currently 10); bought tokens aren't.
- AI allowances are "fair use" limits and reset monthly; unused drafts and the month's CMS Tokens do not carry over (bought tokens do).
- The Free AI allowance is per person: accounts with the same email address, however it is written, share one allowance. Temporary (disposable) email addresses get no Free AI drafts. Free AI drafts for all users together are limited per day, so they may be unavailable late on a busy day; Pro and school plans are not affected.
- We may change plan features, limits or prices for future periods with reasonable notice in the App. A period you have already paid for keeps the terms it was bought under.
- School plans are arranged directly with the school.
4 Payments
- Pro, CMS Interactive and token packs are paid in advance by GCash, Maya or bank transfer to the details shown in the App. After paying, you submit the reference number; your plan starts once we confirm the payment, normally within 1 business day.
- Plans do not renew automatically. Paying again before your plan ends adds the new period after the current one.
- Submitting a reference number for a payment you did not make, or someone else's, is fraud. It will be rejected and may lead to suspension of your account and a report to the authorities.
- Prices are in Philippine pesos. You are responsible for any fees charged by your payment provider.
5 Refunds
We refund in full if we cannot activate your plan, if you paid twice for the same period by mistake, or if you ask within 7 days of activation and have not used the AI Assistant on Pro (for CMS Interactive or a token pack: have not used any of its tokens). Otherwise payments for a period already started are not refundable, except where Philippine law requires. Request a refund at classroommadesimpleapp@gmail.com with your reference number.
6 When a plan ends
A Pro plan has a 3-day grace period after it ends. After that, the account is on the Free plan: all records remain viewable and exportable, but new classes cannot be added beyond the Free limit and AI use follows the Free allowance.
7 Your content and responsibilities
- Records you enter belong to you or your school, not to us. You give us only the permission needed to store, sync and process them to provide the App.
- Enter learner data only for legitimate educational purposes, accurately, and with your school's authority. You are responsible for complying with the Data Privacy Act, DepEd policies and your school's rules.
- Add as game answers or to slides only pictures you have the right to use (that you took, made, or have permission to use), and no pictures of learners or other people or pictures showing personal information: anyone with a picture's address can see it.
- If you think a picture, drawing or anything else in the App uses your work without your permission, write to us at classroommadesimpleapp@gmail.com with its web address (or where in the App you saw it) and how it is yours. We will remove it for everyone, and it can't be added again; we may tell the teacher who added it, who can write to us if they believe they may use it. We may turn off picture uploads for an account that keeps adding pictures it has no right to use.
- Send us only drawings you made yourself: nothing copied from the internet, a book or anyone else's work, and nothing that shows learners or anyone's face, name or personal details. By sending one, you let us add it (or a drawing based on it, changed to match the App's other drawings) to the App, for every teacher using CMS Interactive to use in their lessons, free; you keep your own rights to your drawing. We may turn down any drawing.
- Share to the Pisara library only what you made yourself, with pictures you took or drew yourself: nothing copied from the internet or from anyone else's work, and nothing that shows learners or anyone's face, name or personal details. By sharing it, you let every teacher using CMS Interactive use, copy and change it in their own lessons, free, and let us show it in the App; you keep your own rights to it. We may turn down or take out anything, at any time.
- Keep your own exports or backups of important records. The App keeps local backups, but no service can guarantee against every loss.
8 Sharing with other teachers
When you add another teacher to a class or section you manage, that teacher can see and edit the learners and records of what you shared, under their own account. Share only with teachers who need access, and remove them when they no longer do.
The Pisara library is different: what you share there, once we approve it, can be used by every teacher who uses CMS Interactive, not only your colleagues (see section 7 above).
9 AI Assistant
AI drafts (lesson plans, tests, feedback) are suggestions: review and edit them before use. They may be inaccurate or misaligned with the curriculum, and nothing is saved until you save it. Do not include personal information in AI requests, or in lesson plan files you import with the AI. We choose the AI models used and may limit how often the Assistant can be used.
10 Acceptable use
You must not: access or try to access another account or school's data; get around plan limits, payment checks, waiting periods or security features; copy, modify, decompile or redistribute the App or its AI service; automate or resell access; overload or attack the service; upload unlawful content; or use the App to harass anyone. We may suspend or close accounts that break these rules, and keep the evidence for lawful purposes.
11 Availability and changes
We work to keep the App available and your data safe, but the App is provided "as is" and "as available". Features may change, and the service may be interrupted for maintenance or by events outside our control.
12 Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential losses (such as lost records, lost time or lost income), and our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these Terms limits liability that cannot be limited under Philippine law.
13 Indemnity
You agree to hold us harmless from claims arising from data you enter without proper authority, from your breach of these Terms, or from your misuse of the App.
14 Ending your account
You may stop using the App at any time and ask us to delete your account. We may suspend or close an account for fraud, abuse or a serious breach of these Terms, and will tell you why unless the law or the safety of others prevents it. This includes accounts held by one person to get around the Free limits, and shared accounts. A suspended account can't sign in or use the AI Assistant, but nothing in it is deleted. Its records are kept as they are; contact us at classroommadesimpleapp@gmail.com to ask for a copy (export) of them, or to have the account restored if we got it wrong. Sections 5, 7, 12, 13 and 15 survive.
15 Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines. Please contact us first so we can try to resolve any problem; consumer complaints may also be brought to the Department of Trade and Industry. Disputes are brought before the proper courts of the Philippines.
16 Changes to these terms
We may update these Terms and the Privacy Policy. Material changes are shown in the App and must be accepted before you continue using it.
